Early Steps That Can Protect Your Claim
The hours and days after an injury can feel disorganized, especially when you are dealing with pain, missed work, transportation issues, or questions from insurance companies. What you do early on may affect how well the incident is documented and whether important details are preserved.
Get Care and Track Your Treatment
Your health should come first. Seek medical attention as soon as possible, even if your symptoms seem manageable at first. Some injuries become more noticeable over time, and medical records can help connect your condition to the accident. Follow your provider’s instructions, attend follow-up appointments, and keep copies of bills, prescriptions, referrals, and discharge paperwork.
Keep Records Before Details Are Lost
Evidence can disappear quickly. Take photographs of visible injuries, damaged property, unsafe conditions, weather conditions, lighting, and anything else that may help explain what happened. If anyone saw the incident, try to get their name and contact information. Save incident reports, messages, insurance letters, repair estimates, and any notes about how your injuries are affecting your daily activities.
Be Careful Before Making Statements
Insurance companies may ask for recorded statements or offer early settlements before the full extent of your injuries is known. Avoid admitting fault, guessing about what happened, or signing documents you do not understand. Speaking with a personal injury attorney can help you evaluate your options, understand possible deadlines, and decide how to respond before your claim is affected.

Time Limits for Filing a Personal Injury Lawsuit
Filing deadlines are easy to overlook while you are dealing with medical care, missed work, and day-to-day disruptions. Under New York law, many personal injury lawsuits must be filed within three years of the date of the injury, but that deadline is not the same for every type of case.
Medical malpractice claims generally have a shorter deadline of two years and six months, and wrongful death claims generally must be filed within two years of the date of death. Claims involving a town, county, school district, or other public entity may also require a notice of claim within 90 days. Missing one of these deadlines can limit or prevent your ability to bring a claim, so it is important to review the timing of your case as early as possible.
What a Personal Injury Consultation Covers
Your first consultation is a chance to explain what happened and get a clearer sense of the legal issues that may affect your claim. You can discuss how the accident occurred, the injuries you suffered, the treatment you have received, and any communication you have had with insurance companies. A lawyer can also review available documents, such as medical records, photographs, incident reports, or witness information.
The conversation may address who could be responsible, whether shared fault may become an issue, and what compensation may be available under New York law depending on the facts of your case. You can ask about the claims process, expected steps, potential challenges, and what information may be useful to preserve. By the end of the consultation, you should have a better understanding of your options and what moving forward could involve.
